Terms of Use
1. Agreement
These Terms govern your use of this website and of the software products operated by Tapawingo Labs Inc. ("Tapawingo Labs", "we", "us"). By using them you accept these Terms. If you do not agree, do not use them. Where a product publishes its own terms, those govern that product and these Terms cover the rest.
2. Privacy
Our Privacy Policy explains what we collect and how we use it, and is part of these Terms. We do not sell personal information.
3. The products
Tapawingo Labs designs, builds, and operates software solutions for small to large organizations, including bespoke custom software. Our first product is in private beta with pilot organizations. We may add, change, or retire features at any time.
4. Acceptable use
- Do not break the law, or encourage anyone else to.
- Do not impersonate anyone or misrepresent an affiliation.
- Do not scrape or collect other users' information, or use our products to send spam.
- Do not upload malware, probe or overload our systems, or bypass access controls.
5. Your content
You keep ownership of the content you provide. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for technical purposes, and display it solely to operate, secure and improve the products, and as directed by you and your organization's settings. That license ends when the content is deleted, except for backup copies kept for a limited time.
6. Text messages
Tapawingo Labs does not send text messages. Where a software solution we operate offers text notifications, they are sent by that solution, they are optional, and they are off until the account holder turns them on. What a solution sends and how to stop it are set out in that solution's own terms and privacy policy.
These bind every solution we operate. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent are not shared with third parties. A mobile number goes only to the messaging provider that delivers the message, for that sole purpose. No solution sends marketing or promotional texts.
Message frequency varies with the organization's activity, typically 0 to 5 messages per week, and message and data rates may apply. Every solution honours STOP to opt out and HELP for help, and opting out never affects your account. See the Privacy Policy and Text messaging for the full statement.
7. No advertising
We carry no advertising. There are no ad units in our products, no advertising or ad-measurement scripts on any page, and we build no advertising profiles. We do not sell advertising or sponsorship placements, and we have no plans to.
8. Intellectual property
The website and our products, including software, design, logos and the Tapawingo Labs name, belong to Tapawingo Labs Inc. and its licensors. Third-party services we integrate with are trademarks of their owners; their appearance is functional, not an endorsement in either direction.
9. Disclaimers and liability
The website and products are provided "as is" without warranties of any kind to the fullest extent permitted by law. To the extent permitted by law, Tapawingo Labs is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits.
10. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Except where another forum is required by law, the state and federal courts located in Virginia have exclusive jurisdiction.
11. Changes
We may update these Terms. Material changes will be posted here with a new effective date.
